Welcome to FreelanceERP These Terms of Service (“Terms”) govern your access to and use of the FreelanceERP platform and services available at FreelanceERP.com.
By creating an account or using our services, you agree to these Terms. If you do not agree, please do not use our website.
1. General Overview
FreelanceERP is an online marketplace connecting ERP professionals (“Freelancers”) with companies and clients (“Employers”). The platform facilitates communication, project management, and secure payments between both parties.
2. User Accounts
- Users must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your account and password.
- FreelanceERP reserves the right to suspend or terminate any account that violates our policies or engages in fraudulent activity.
3. Project Payments and Escrow Protection
- When a project starts, the Employer deposits the agreed payment into FreelanceERP’s secured escrow system.
- Funds remain on hold until the Freelancer completes the project.
- Once the Employer approves the work, FreelanceERP releases the payment to the Freelancer (minus service fees).
- If a dispute arises, FreelanceERP may mediate and hold the funds until resolution.
4. Service Fees and Withdrawals
- FreelanceERP charges a 20% service fee on each completed contract.
- The remaining 80% is transferred to the Freelancer’s account after project approval.
- The minimum withdrawal amount is $250 USD.
- Standard payout processing time is up to 5 business days, except for users with a Revolut account, where transfers may take less than 1 day.
- All transaction and currency conversion fees are the responsibility of the user.
5. Cancellations and Refunds
- If an Employer approves a project and later requests cancellation, 10% of the project value will be deducted as a platform service fee.
- If a project is cancelled before approval, the full amount (minus payment processor fees) will be refunded to the Employer.
- Refunds are processed within 7 business days after request confirmation.
6. Off-Platform Collaboration (Bypassing the Platform)
FreelanceERP strictly prohibits Employers and Freelancers from:
- Exchanging contact information for direct cooperation outside the platform;
- Attempting to avoid platform fees or payments through external agreements.
Violation of this rule will result in immediate account suspension.
If funds are held in escrow, they may be frozen or forfeited depending on the investigation results.
7. Dispute Resolution
- If a disagreement occurs between an Employer and a Freelancer, both parties must first attempt to resolve it via FreelanceERP’s internal messaging and support.
- If unresolved, FreelanceERP reserves the right to make a final decision based on evidence and project records.
8. Taxes and Legal Compliance
Each user is fully responsible for reporting and paying any taxes or legal obligations in their own country. FreelanceERP does not withhold or remit taxes on users’ behalf.
9. Intellectual Property
All intellectual property created by the Freelancer belongs to the Employer after full payment is released, unless otherwise stated in writing.
10. Account Suspension and Termination
FreelanceERP may suspend or terminate accounts that:
- Violate these Terms;
- Engage in fraud, abuse, or bypassing the platform;
- Cause harm to other users or the company.
Any funds under review may remain on hold until a decision is finalized.
11. Limitation of Liability
FreelanceERP provides services “as is” and makes no guarantees of continuous operation.
We are not liable for indirect, incidental, or consequential losses resulting from the use of our platform.
12. Governing Law
These Terms shall be governed by and interpreted according to the laws of the United Arab Emirates (Dubai).
Any legal disputes will be handled under UAE jurisdiction.
