5. Legal Bases for Processing Under the GDPR

Where the GDPR applies, we rely on one or more of the following legal bases, depending on the processing activity:

Contractual Necessity

We process data when it is necessary to create or perform our agreement with you, including account management, project administration, payments, withdrawals, and customer support directly related to the service.

Legal Obligations

We process information when required to comply with applicable laws, including tax, accounting, financial, fraud-prevention, and lawful reporting obligations.

Legitimate Interests

We may process information when necessary for legitimate interests, provided those interests are not overridden by your rights and freedoms. Such interests may include platform security, fraud prevention, service improvement, enforcement of platform terms, and the establishment, exercise, or defense of legal claims.

Where required, we assess the relevant interests and safeguards.

Consent

We rely on consent where required, including for certain non-essential cookies, electronic marketing, or other processing activities for which consent is the appropriate legal basis.

You may withdraw consent at any time. Withdrawal does not affect processing that took place before consent was withdrawn, and it does not affect processing based on another valid legal basis.

Vital Interests or Public Interest

Where applicable, we may process personal data to protect vital interests or to perform tasks carried out in the public interest when a relevant legal basis exists.

We do not assume that one legal basis applies to every activity. The applicable basis depends on the specific purpose and circumstances of the processing.

6. Project Confidentiality and Dispute Resolution

FreelanceERP may need to examine project information when a dispute is submitted by a client or freelancer.

During a dispute review, authorized specialists may need to access relevant project information, including:

  • The original project description and agreed requirements.

  • Messages, meeting notes, and documented agreements.

  • Source code, modules, configuration files, and other deliverables.

  • Technical demonstrations, screenshots, and test results.

  • Project progress records and milestone information.

Access to dispute materials is restricted to authorized personnel and service providers who need the information for the relevant review or associated operational or legal purposes, subject to applicable confidentiality and security obligations.

We do not publish dispute evidence publicly or disclose it to unrelated users for general access. However, relevant information may be shared where necessary with the parties to the dispute, authorized service providers, professional advisers, or competent authorities when legally required or otherwise permitted by law.

Users should not upload unnecessary personal data, passwords, payment card details, or unrelated confidential information as dispute evidence.

Our handling of dispute materials is also subject to our Terms of Service, applicable retention requirements, and relevant legal obligations.

7. Who May Receive Your Personal Data?

We do not sell personal data to third parties.

We may disclose personal data to the following categories of recipients where necessary and lawful:

Other FreelanceERP Users

Certain profile and project information is shared with other users to operate the marketplace. For example, clients may see freelancer profiles and proposals, while freelancers may see project descriptions and relevant client information.

Messages, files, and project materials are shared with the users authorized to access the relevant project or conversation.

Payment and Financial Service Providers

Payment processors, payout providers, banks, and related service providers may receive information needed to process payments, refunds, wallet-related transactions, identity verification, and withdrawals.

Hosting and Technology Providers

Our hosting providers, cloud infrastructure providers, database services, file storage services, email providers, monitoring services, and technical support providers may process information on our behalf to operate and secure the platform.

We may use authorized providers to verify identities or transactions, detect abuse, investigate suspicious activity, and protect the platform.

We may disclose relevant information to lawyers, accountants, auditors, regulators, courts, law enforcement authorities, or other public bodies where necessary to comply with legal obligations, establish or defend legal claims, or protect rights and safety.

Business Transfers

If FreelanceERP is involved in a merger, acquisition, restructuring, financing, or sale of assets, personal data may be transferred as part of that transaction, subject to applicable legal requirements and appropriate safeguards.

We require service providers acting as processors to process personal data in accordance with applicable data protection requirements and appropriate contractual arrangements.

8. International Data Transfers

FreelanceERP may serve users located in different countries. Some of our service providers or infrastructure may be located outside the European Economic Area (EEA).

Where personal data is transferred outside the EEA, we will use a transfer mechanism permitted by applicable data protection law, where required. This may include an adequacy decision, Standard Contractual Clauses, or another valid transfer mechanism, together with any supplementary safeguards required by the circumstances.

You may contact us for further information about the applicable safeguards for relevant international transfers, subject to legal restrictions.

9. How Long We Retain Personal Data

We retain personal data only for as long as necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

Retention periods depend on the type of data and the reason it is processed. For example:

  • Account data: While the account remains active and for a reasonable period afterward where needed for account administration, security, or legal obligations.

  • Profile and project data: While needed to provide the marketplace services, administer projects, resolve disputes, or meet applicable obligations.

  • Payment and accounting records: For the period required by applicable tax, accounting, and financial laws.

  • Dispute records: For as long as necessary to review the dispute, administer the outcome, address related claims, and meet applicable legal obligations.

  • Security logs: For a period appropriate to the security purpose, incident investigation, and applicable requirements.

  • Marketing preferences and consent records: As long as necessary to honor your preferences, demonstrate compliance, and manage lawful marketing activities.

When personal data is no longer required, we will delete it or anonymize it where appropriate, unless retention is necessary for legal claims, compliance, security, or another lawful purpose.

The specific retention periods and deletion procedures should be documented in our internal data retention policy.

10. How We Protect Your Information

We use appropriate technical and organizational measures designed to protect personal data against unauthorized access, accidental loss, alteration, disclosure, and destruction.

Depending on the systems and services involved, these measures may include:

  • Access controls and role-based permissions.

  • Authentication and account security measures.

  • Encryption in transit and, where appropriate, at rest.

  • Secure hosting, backups, and recovery procedures.

  • Logging and monitoring for security-related events.

  • Confidentiality obligations for authorized personnel.

  • Security reviews, updates, and vulnerability management.

  • Procedures for handling suspected data breaches.

No website, platform, or method of electronic transmission can be guaranteed to be completely secure. We therefore cannot promise absolute security, but we work to maintain safeguards appropriate to the risks and applicable legal requirements.

Users are responsible for keeping their credentials confidential and promptly reporting suspected unauthorized access.

11. Personal Data Breaches

If we become aware of a personal data breach, we will assess the incident and take appropriate steps to contain, investigate, and mitigate its effects.

Where required by the GDPR, we will notify the competent supervisory authority within the applicable legal timeframe and inform affected individuals without undue delay when the breach is likely to result in a high risk to their rights and freedoms.

12. Your Rights Under the GDPR

Where the GDPR applies, you may have the following rights, subject to the applicable legal conditions and exceptions:

  • Right to be informed: To understand how your personal data is processed.

  • Right of access: To request access to your personal data.

  • Right to erasure: To request deletion of personal data in circumstances provided by law.

  • Right to restriction: To request that certain processing be restricted.

  • Right to data portability: To receive certain data you provided in a structured, commonly used, machine-readable format and, where applicable, transmit it to another controller.

  • Right to object: To object to processing based on legitimate interests or to direct marketing, as provided by law.

  • Right to withdraw consent: To withdraw consent where processing is based on consent.

  • Rights relating to automated decision-making: To benefit from applicable safeguards where decisions covered by Article 22 of the GDPR are made solely by automated means and produce legal or similarly significant effects.

  • Right to lodge a complaint: To lodge a complaint with a competent data protection supervisory authority, particularly in the EU country of your habitual residence, place of work, or the place of the alleged infringement, where applicable.

These rights are not absolute and may be subject to legal exceptions. For example, certain payment, accounting, fraud-prevention, or legal records may need to be retained even if you request account deletion.

To exercise your rights, contact us at [email protected]. We may request reasonable information to verify your identity before responding.

We will respond within the time limits required by applicable law. Under the GDPR, the usual deadline is one month, subject to permitted extensions in complex or numerous requests.

13. Account Deletion

You may request the deletion of your account by contacting us at [email protected] or by using an available account deletion feature.

After verifying your request, we will delete or anonymize personal data that we no longer need to retain, subject to applicable legal obligations, legitimate retention requirements, the handling of outstanding transactions, and the establishment, exercise, or defense of legal claims.

Deleting your account may limit access to your project history, messages, or other platform features. Where certain records must be retained, we will restrict their use to the purposes for which retention is necessary.

FreelanceERP may use cookies and similar technologies to:

  • Enable essential website functions and secure login sessions.

You can manage your preferences through our cookie settings where available. More information about specific cookies, their purposes, providers, and retention periods should be provided in a separate Cookie Policy or a detailed cookie notice.

15. Marketing Communications

We may send service-related communications necessary to manage your account, projects, transactions, security, or changes to our terms and policies.

Where permitted by law, we may also send promotional communications about FreelanceERP services, features, or updates.

Where consent is required, we will obtain it before sending marketing communications. You can opt out of marketing emails by using the unsubscribe link or contacting us. Opting out of marketing will not prevent us from sending essential service communications.

16. Automated Processing and Artificial Intelligence

FreelanceERP may use automated technical processes to support functions such as security monitoring, spam detection, fraud prevention, search, or platform performance.

If we introduce profiling or automated decision-making that is subject to specific legal disclosure requirements, we will provide additional information about the purposes, relevant logic, and expected consequences, together with applicable rights and safeguards.

We do not represent that every decision or assessment on the platform is automated. Where a decision falls within the scope of Article 22 of the GDPR, we will comply with the applicable requirements.

17. Children's Privacy

FreelanceERP is intended for individuals who are legally able to enter into binding agreements under the applicable laws and platform terms. It is not designed for children.

We do not knowingly collect personal data from children where doing so would be unlawful. If you believe that a child has provided personal data in violation of applicable requirements, please contact us so that we can assess the situation and take appropriate action.

This Privacy Policy does not govern independent third-party websites or services.

19. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our services, technology, legal obligations, or data processing practices.

The updated version will be published on this page with a revised “Last Updated” date. Where required by law, we will provide additional notice or obtain consent before implementing changes that require it.
